General conditions of sale
1. General
The present general conditions of sale have the aim of governing the contractual relations between company Geko Marine Services and the Customer by accepting the present General Conditions of Sale.

2. Products - Services
The products and services are those definite on the Web sites Geko Marine Services, Geko Yacht Services and PC on Board, like those appearing in specific price quotation. (the sale and hiring of boats are not concerned, nor the services of maintenance of the boats)

3. Period of validity of the offers of sale
The products are offered with the sale until exhaustion of stock. For the products not being in stock in our warehouses, our offers are valid subject to availability in our suppliers. In the event of ordering of an inalienable product, the customer will be informed by email as soon as possible. The validity of the offer is mentioned in each specific offer.

4. Price of the products - Orders
The prices appearing on the Web site or in our offers, are expressed in Euros and mean all inclusive of tax (including all taxes), except costs carriage. They can beings modified constantly and without notice.
The orders can be carried out on line on the Web site, by e.mail or postal mail.
All the orders will be taken into accounts only with the reception of the cheque of installment or the amount claimed in the offer.

5. Commercial conditions - Payment - Invoicing
The commercial conditions are mentioned in each specific offer (price, possible handing-over, financial conditions, mode of payment, delivery period...).
The invoicing includes/understands the detail of the price of each product HT with, if necessary, the amount of the VAT calculated on total HT and included in total including all taxes.

6. Delivery
The delivery is done with the address specified by the customer at the time of the passage of his order. It will be carried out by the Post office or a conveyor. She will be able to intervene only one time the order validated by the customer and the payment carried out in her entirety
If the ordered product is available in stock, the time of forwarding is of approximately 2 days wrought. In the event of out-of-stock condition, the replenishment time is approximately 1 week.

7. Complaint - Cancellation of order
Any cancellation of order, whatever is the reason, and accepted by company Geko Marine Services will give right to the only refunding of the versed sums. No compensation relating to this cancellation could be required.
By signing the delivery form, the customer accepts the products delivered in the state and consequently no complaint relating to sudden damage lasting transport will be accepted. It is responsibility for the customer to carry out all checks and to make all reserves on arrival of the material and to exert, if necessary, all recourse against the conveyor.
With the reception of the goods, the customer must immediately check their state and their conformity compared to the contract. This checking must also be done, if necessary, on the internal state of the assembled PC. All complaints relating to a defect of the delivered goods, an inaccuracy in the quantities or an erroneous reference compared to the order confirmed by company Geko Marine Services, must be formulated in writing within five day with reception of the goods in the absence of what the right to the complaint will cease being acquired.
Geko Marine Services cannot in no case to be held to compensate or cancel an order following impossibility of using the product bought on account of the incompatibility with the material or software already had by the customer.

8. Guarantee and after-sales service
All the market products are guaranteed one year return-workshop (starting from the delivery date).
Any intervention of company Geko Marine Services beyond the first year of guarantee will be invoiced, (the intervention and transport charges will be established as a preliminary in an estimate).
In the event of return of material proving nondefective, of the test and handling, transport charges (at the time cost of 60 € Including all taxes) could be invoicees with the customer. This guarantee does not cover the damage resulting from accidents, misuse or negligence.
Any return of goods, except times of retractation, requires prior agreement of company Geko Marine Services and obtaining a number of return delivered by this one to the customer, who must very lisiblement be registered on any turned over parcel. The return of the goods is carried out with the expenses, risks and dangers of the customer. The products turned over by conveyor without physical protection or badly protected will not be able to profit from the guarantee, it thus rests to the customer to take care to protect and ensure the products turned over during their transport.
It is up to the customer to preserve packing, accessories provided with the product as well as the possible labels affixed on the product or its packing, and which is necessary to profit from the guarantee offered.
Any data back-up necessary will have to be carried out by the customer before his return of material. Geko Marine Services does not guarantee to in no case the data contained on this material, nor its recovery, and could not be held for person in charge for an unspecified loss of data being on a hard disk or media.

9. Right of retractation
As from the delivery date of the order, the customer has a 7 days deadlines to take advantage of his right of retractation, and to be completely refunded - the expenses of reference of the goods remaining with load of the customer. However the products incomplete, used, damaged or dirtied are not taken again. For any return of goods within retractation a written agreement will be transmitted.
In accordance with the ordinance n¡2001-741 of August 23, 2001, this time of retractation is not applicable:
O With the software, since the seals are broken or open packing
O With the computers assembled to measure according to specifications' of the customer

10. Reserve property and responsibility
Company Geko Marine Services preserves the property of the goods until their integral payment on behalf of the customer. The transfer of property of the products to the customer is carried out at the time of the integral payment of the price. However, during the period running out of the delivery to the transfer of property, the risks of losses, flights or destruction are the responsibility of the customer.

11. Litigations
Contractual information is presented in French language and the products offered with the sale are in conformity with the French regulation. If necessary, it rests to the foreign customer to check near the local authorities the use potential of the product which he plans to order. Company Geko Marine Services could not be committed in the event of non-observance of the regulation of a foreign country.
All the disagreements relating to the execution and the suspension of the contractual obligations between the parts not being able to give place to an amicable settlement will be subjected to the jurisdiction of the Commercial court of Antibes, France.
